What is the name of your state? Oregon
4 years ago my children were in foster care. The charges were eventually dismissed. I have custody of both of my children I have a child with special needs that the state requires me to have a delegating RN is delegate my staff. I began interviewing RN's and had this one RN come over she mentioned when she got to my house that she has known my child in the past when my child was in foster care she took care of my child for a short while as my child's school nurse. She told me that my children were removed from my home due to the fact that my child was ill. (Which is untrue!) She began telling me how she was going to run my home. So I told her she was not a match for my family. I was also told in front of witnesses that she was given all of this information by my child's former foster mom (Whom is also an RN) and that she has the right to check all of my childs medical records without my consent. She does not need me to sign a release of information.

Oops, sorry the question was:

Can the foster mom go around spreading rumors that are untrue such as my children were taken because they were ill? And does this fall under HIPPA?

Of course she can. It's called an opinion.

IF she received the information from your children's medical file then she is STILL not liable for anything but bad judgement. The MEDICAL professional who showed her the information would be however.

So, how many $1,000s of your own money do you have to try and PROVE this is the way it occurred instead of an opinion which she and every other citizen has the right to?
