i purchased an item from ebay. supposed to be authentic coach purse. turned out to be a fake. i communicated via email with the seller who states he never claimed it to be authentic. i was told which it also states in the ebay ad for the purse that i can return it and i will be refunded minus shipping and ins. fees. so i returned the purse to the address given. and it was recieved by the seller and i have yet to get my money back. i paid via paypal. the seller emailed me with a bogus transaction number from paypal that a refund was pending. i contacted paypal and they have no record of it. i tried to go through ebay and i tried to go through paypal to get my money back but they say i need to get it from the seller on my own. i thought i had some kind of buyer protection but it turns out that is only if you don't recieve item or some other causes. i have contacted the seller numerous times. and i have yet to get my refund. i have even told him my lawyer will contact him. and things of that nature to kind of get him to reply but to no avail. what is my next step if i hire a lawyer it will probably cost me more than what the person owes me. is there any kind of free service where a letter from a lawyer can be sent to the seller. i have copies of the emails he has sent me. i have his address also. please help me with this i am so upset i hate to be taken advantage of.

What state does the seller live? If you want to bring legal action, that is where you will have to do it.

Not true. Lots of Internet law out there these days. Also if it was mailed then general jurisdiction can be had in the receiving state.

I am keeping an eye on you bud so beware.

You have now learned a lession about eBay and especially about Paypal. Use both with great caution. eBay can produce som good results but watch out for the "power Bayers" with lots of sales.

If you paid with a credit card call them and dispute the charge, you win. If not then forget it and move on but notify eBay so the seller will be on notice. Typically, the real scammers have multiple accounts and names so realistically there is little you can do.

Lawyers will cost far more than you will ever recover. That is the way the system is designed and they will bleed you a little at a time.

If the seller was from California, how much is a New Jersey judgment worth? Not a penny in California. So what good does it do to sue in the OP's home state? I was sued in Ohio over an eBay transaction, the buyer even sent me a nice copy of the judgment. And that judgment is worthless in my state. And a disgruntled California buyer had his lawsuit against me dismissed based on lack of jurisdiction, the judge agreed with my answer to the lawsuit that California does not have jurisdiction over a transaction (exchange of funds for goods) that took place in my state of Washington. Unless you can provide some specific proof, I say your full of BS. Yeah, keep your eye out, you might just get it poked when you least expect it.

What the hell is a coach purse, let alone an "authentic" coach purse? Do they cut a big pouch in Phil Jackson's nutsack like a kangaroo, or what?

What does federal civil procedure have to do with any of this? Unless this Coach purse has a value of over $75,000, this isn't going to federal court -- it's going to state court.

thanks for advice!! issue resolved.

hey thanks for all your help. i recovered a full refund including shipping and handling. i got some expert advice from a friend in the corrections dept.
i called the police of the persons town and gave then information on what was happening and they gladly went over to the persons home and investigated. i recieved my full refund with in 4 days. the person was told if he didn't refund the money the investigaters will be back. and since he is selling fake coach bags which is illegal i'm sure he did not want any more trouble. and hey it was much cheaper for me this way then to take off work and go to small claims court and also less frustrating. hope this can help someone else out there. take care.
