Its been 2yrs since the accident

2 yrs ago this pass jan I was involved in a accident where someone pulled out in front of me as I was driving down the highway.. I was hurt in the accident a neck sprain but it still affects me til this day..

However i was going through a divorce at the time and had signed a document to cancel my insurance and was in the process of getting new in surance I hadnt realized that it expired right away I thought I was given time, I was able to get new tags w/ the old card thinking it was okay... Anyways I am now being sued I dont know for what yet, but what will happen to me I am a single mom, I am on SSD and I own nothing not even a bank acoount.

1. Who was at fault f/ the accident?
2. Did you have insurance at the time of the accident?
3. When you cancelled your insurance why didn't you ask them if there was a grace period? When you cancel it it's cancelled right away.

I am assuming that the accident was your fault since you did not state otherwise. What will happen is that they will take you to court and the court will decide the amount that the other party is to receive. They will then enter a judgement against you and try to collect.

Since you have nothing and own nothing there is little they can do. You would have the option of filing for bankruptcy.
 
Agreed Lwpat. Also what you may want to know is even though you have nothing. They will probably get a judgement against you and, In most States they are Suspending driving privledges regarding Judgments. What it may say via DMV is susupended or revoked for unsettled Judgement. That can be a hell of a lot of stress you really don't need especially being a single mom. As Lwpat had eluded to is seeking a lawyer and if you can file for Bankruptcy, that should lift the Judgement. Best of Luck. Not Advice. For what it's Worth. Patrolman/J. Buckner

well I had the right away when they pulled out onto the major highway.. I was never issued a ticket, now they are sueing I dont know for what yet the sherrif's dept has been trying to deliver it to me but since I have to be home I have yet to recieve it...

If you were not at fault f/ the accident then they would not win a lawsuit against you f/ their injuries. A lot of these are scare tactics by atty's attempting to try and settle.

Even if I had no insurance, can they take away my license, it has been 2yrs and 3 months since the accident... I have been insrued since then...

If you get a judgement against you in court and don't pay you will have your license suspended. It's doubtful they would suspend them otherwise at this point. The bottom line is you weren't at fault f/ the accident. You can't be liable f/ property damage and injuries if it wasn't your fault.

You may want to consider getting an atty to defend you. You may be able to countersue f/ the damage to your car. having no insurance makes it hard to sue f/ injury. States ususally have laws to prevent collecting judgments on injury f/ driving w/o insurance.
