Its time to evict low life tenant.

What is the name of your state? Pennsylvania.
Here is the long story made short. My brother passed away this past march and he left the building to me. The tenant on the 2nd floor decided to take advantage of the situation and just stop paying rent.

Even though im new to being a landlord (but learning the ropes really fast) i approached her and let her know that she needs to pay her rent and im not going to tolerate anything. I sent her a registered 30 day eviction notice. She signed for it and called me on the phone begging me to let her stay there. I let her know that she can't be that worried about it cause up until now she still has not payed and its going on 3 months. She is supposed to be out this saturday which will be 30 days from the time received the letter.

It doesn't look like she is going to be leaving so now i have been told that i have to file a complaint with the sheriff of Pa and go through the whole court thing.

What i want to know is what is the exact procedure when i file a complaint against her and how much time is envolved. The deed was just recently recorded in my name and i do have a renters license and belong to a home owners association.

I can't afford to have her live there for free and i want her gone asap. Also is there anything else i can do to get rid of her without doing anything out of line that she may be able to use against me in the future.

If you're going to be a landlord, get a lawyer who will file these evictions for you.

It's a lot cheaper in the long run.

Hire a lawyer. Your tenant is already 3 months behind and will not pay - or move along - unless you take the proper steps to make it happen.

I could do my own evictions, but prefer to let my attorney handle them - though few and far between.

The paperwork must be filled out and served properly. If not, your case can get thrown out and you will have to start over.

More time ... more lost rent.

File an eviction -- unlawful detainer -- request "post and serve"
It will be about 30 days before your court date -- probably no rent pay
If she doesn't show up -- you won by default -- probably another 10 days before you can get sheriff and put her out.
If she does show up -- you may be up for a ride -- however, you will probably win unless she has something on you.
Filling this way will not get you any rent she owes -- you will have to file separate court date for that if you really want it -- probably not worth it!
