What is the name of your state? Va
My fiance was fired from his job, but got it back 28 months later because of the union and arbitration. The job says he has to take out any money earned while fired. plus he got laid off from the temp job and got unemployment for a while. is this true or can it be fought? he lives in PA, also would he be entitled to what others made on overtime, like an average of the other workers.
it just doesnt seem right : if he worked 2 jobs and then lost one and then got it back on arbitration, why should he get the salary minus the second job?? help please

I presume the reinstatement agreement says he will receive backpay? If so, then the goal is to make him financially whole, in which case reducing the amount of backpay he is due by deducting any wages and UC benefits he received during that time is appropriate.

He didn't work, therefore the employer doesn't owe him any wages. The terms of his reinstatement and any backpay are entirely subject to the agreement made between the union and the employer.

why should he get the salary minus the second job See my first answer.
