What is the name of your state? Florida
My aunt died this year and she had a checking and savings account with Bank of America in Florida. On this account my mother and I were both listed on all the accounts. Can we now withdraw this money and split it equally or does this money have to be put into her estate banking account and be listed in probate? What is the name of your state?

My response:

Call the bank tomorrow. Ask them if you and your mother signed a "Right of Survivor" agreement. If so, the money is automatically yours - - as the "survivor."
