In New York state, on 9/1/2000 I and my live-in boyfriend of 2and a half years co-bought our second car. It is a 2001 auto with a jointly signed(not signer and co-signer)loan. It was his proof of income and my proof of good credit history together that allowed us to get the loan and the verbal understanding was that the car was for my primary use,it was purchased on my birthday and presented as my birthday present. And,as the other auto that we have another loan on is his work vehicle, this was to be my car.
Within days of our car purchase, he started an intimate relationship with another woman, moved out and took my car to give to the other woman. While the loan is our equal responsibility(he has made all payments, but I am obligated to all responsibilities of an owner, including being sued for any problems not covered by insurance ie. drunk driving accidents by either of them), the title is in his name only, so I have no rights to possession of the car or even to say who can or cannot use it(I've already been through all these facts with the police)
I would like to know if I can sue him for breech of our oral contract(obviously, I wouldn't sign for a $40,000 loan to give another woman a new car, while I am now borrowing a car from a friend)or fraud for intentionally mis-leading me in order to obtain a loan?
I do not want to sue him for money or possession of the car (because I cannot afford the payments on my own). What I want is for him to refinance or sell the car, to release my name from the loan contract.
