Of course you do! How was joint custody already established without a CS order in place too? In most joint custody cases the child lives with one parent as his primary residence....let's assume it's you since you didn't say...... so you would be the custodial parent. The other parent would be the non-custodial parent, will have a visitation schedule, and will have to pay cs to you.....the custodial parent. File for cs asap. Your child deserves it and it's his right. Since you are unemployed, file thru your state child support/enforcement collection agency. It's free to do this. However, be aware that this takes time. It can take many, many months because all state CS collection agencies are unindated with cases just like yours every month. So in the meantime, you will have to figure out how to support your child on your own. Good luck!
