Los Angeles, CA. Have a joint month-month lease in a 2 bedroom apartment. When my former room-mate moved out, and the current one moved in, his name went on the lease, in addition to mine, and he paid a security deposit (to management). All utilities are in my name. 90% of apartment furniture is mine. I want my current room-mate to move out. This is due to arguements and conflicts. In addition to which he drew a gun on the former manager when she entered the apartment (with a plumber to fix a leak). I was not aware of this until recently (his excuse was that he was protecting himself against possible intruder), and am not comfortable sharing apartment with a gun owner. However, I'm uncertain what legal rights I have in enforcing him to move out.
Due to an oversight the joint lease we signed was never returned to management. Managment, therefore, has no copy of the original signed joint lease. Can I ask managment to draw up new lease under my name only, and will I then have the right to demand that my room-mate move out?
