We took a married individual named James to small claims court for the amount of $3300.00 that he owed. We possess a signed affidavat power of attorney that is signed and notarized by him that he will pay the debt. He filed bankruptcy and halted all collections we could preform. The debt was incurred while married to his wife which he is currently married to. Filed Alias in small claims court to persue her for the debt because Colorado to my understanding is a community property state. Is this true and if so what is the law that allows or govern this action?
