What is the name of your state (only U.S. law)?

2 people own a building in equal shares. One person uses the whole of the building to run his own business. The two people fall out. The person who does not own the business, now wishes to claim half the building, by partitioning the building if needed. If this occurs the other person will no longer be able to run his business effectively. Is this legal.

Certainly, if the court grants the partition. The impact on the other party and the feasibility of "partitioning" may determine what form the actual partition may take.

**A: in most cases a building cannot be partitioned but the real property that the building sits on can be. And the answer to your question is yes it is legal.
