How common does a judge award Joint physical custody? Especially where there is 4 town distance approximately 25 miles between the two households. Children are 10 and 8 and that is the recommendation of a GAL. I am still baffled because in her report she doesn't even mention that I am a stay home mom, she states in her report that ex and wife have violent and constant fighting going on but yet she wants my children to reside with him. Just totally confused and worried and sick at heart. Any input will help. Thanks.

Joint physical custody is fine for a newborn up until school age or if both parents live in the same area. For your situation, it is a recipe for disaster and the GAL should know better. If you have an attorney, you should argue your case to the judge and point out the total nonsence of the recommendation. Does the GAL suggest which town they school at?

My lawyer said it makes no sense whatsoever. We have so much documentation against my ex and wife it is not funny. She recommends my son go to his house and go to school there. Go figure, my son AB student, my daughter is C D student. We are getting an expert to review her report and recommendation and it should help us in court. Update, my ex has been very thoughtful the last two weeks. He has NEVER called to let me know he'll be late in picking Jonny up nor call when he will be alittle late. Also, today I fell down my front steps and thought I broke my ankle, had xrays not broken bad sprain, ankle brace and crutches for two weeks, I call him and tell him I cannot pick Ellen up as I sprained my ankle and on crutches, he calls back 20 minutes later and says he will bring her to me and pick her up, here is a man, last year when I had major knee surgery PCL he wouldn't bring her to me at all. I think he is scared or something. Leopards don't change their spots. LOL

sounds like he has been told to be cooperative and helpful to you by his attorney. you are right though, as soon as the case is over, it will fade away.
