NJ Discruntled ex spouse will not sign over stocks that are registered as joint ownership and were awarded to the other spouse in the divorce settlement. Do you have to have his signature even though you have the divorce settlement documentation from the courts?

My response:

Yes. The brokerage firm needs both signature pursuant to SEC law - - just like any other negotiable instrument.

Your recourse is to take that ex-spouse back to court for an "Order to Show Cause - Re: Contempt of Court Order".

Not only will the court force that spouse to sign the certificates, but will make that spouse pay for your attorney fees, and will also be found in Contempt of Court, and most likely be required to spend at least a weekend in jail.

Courts REALLY, REALLY hate it when someone disobeys court orders.
