I went to superior court to enjoin a foreclosure sale due to lack of standing. The other party did not show up. Why was I not granted the request?

Well, you see, I know this biased judge. He took our crystal ball and gave it to his dog Violet to play with. The more we ask SJ to give us the ball back so that we can answer these types of questions, the more he says "neener neener neener."

Simple answer: We don't know. We weren't at the hearing, so we have no idea exactly what was said there.

A lot of Plaintiffs think that just because the other party doesn't show up in court that it is an automatic win for their side. Not true. You still have to prove your case before the judge. The part that's missing when the Defendant fails to show is THEIR SIDE of the dispute.

If your case doesn't stand up on it's own, then that's probably why the judge didn't grant your request.

The hearing took about 5 minutes. He said you haven't paid your mortgage? I said yes but have been trying to no avail to work with lender. In checking records I found they don't own the note. Trying to stop foreclosure sale due to lack of standing. He said, well you are behind and I said yes but to another lender. That was it.

What evidence did you present to show that they don't own the note?

He didn't let me show anything. He had the paperwork I filed but I don't think he really went through it. The note is missing - MERS is assignee - famous robo-signer signed defendant's documents as vp of MERS - they didn't answer qwrs, etc.

So, in a nutshell, you couldn't provide any proof of your assertions. Seems to me that we've found the answer...

I had proof for everything I said - he simply would not even hear the evidence I had. He was more concerned about the money owed.

Thanks for everybody's great help - it was really informative.

Um...doesn't that come AFTER the other side shows up? Besides, prove a negative. We must first have the note in evidence by the party claiming it, don't we?
