Judge closed probate, heirs still want more.

What is the name of your state (only U.S. law)? NY.
The judge has closed the probate to my father's Will. The liquid assets has run out althought my father offered more than he had. The judge was satisfied but not all the heirs were. Even though the case is closed can the heirs review the final accounting and sue the executor? I was told that wouldn't be the case. :confused:What is the name of your state (only U.S. law)?

Go get a copy of the probate file to review. If the bills are all paid, and then there isn't enough money for you, then there isn't enough money. The probate file will show all the assets that were available, and who got paid what.

Liquid is not relevant. If there are other assets, they must be liquidated if there are still bills to be paid.

Now, if you simply meant there are no assets remaining, then that;s the end of things.


as to the heirs wanting more; if there isn't any, they don't get any. It doesn't matter what a person wills to others. If the estate doesn't have the assets, it is meaningless.
