Our health club sued landlord for $800k and jury awarded $676k.
Evidently the defendant argued inadequate defense by his lawyer and had the verdict set aside. New jury trial set for Dec. 3, 2003. My question is: Everyone presents new figures or does the new trial start with last judgement figures? Either way, is a setting aside of a decision common and represent a bad thing? As a shareholder, we've already waited 3years and still this occurs....as a side question, can I also file lawsuit against my own 'side' to a claim of my portion of holdings to avoid any further delay in payback should we win again? Thanx very much...
