I have a modified judgement that my ex-wife will be responsible for paying the remaining months on the orthodontist bill for my daughter. Since the modified judgement she has not made any payments. They are threatening to send it to collection against myself. What are my options? Should I pay the bill and take her to small claims court. I sent a letter to her attorney but they have not done anything. Or, should I advise the orthodontist that she is now responsible although I am the one who initially signed the contract.:confused:

You are very probably listed in the records as the (or one of the) responsible parties to this bill.

You need to pay the bill to protect your credit record. Then, since you have documentation to support that this bill is the responsibility of the 'ex', take her to court to recover your damages.

In the future, I would make sure that your name is removed as a responsible party.

Can I take her to small claims court or do I go back to the circuit clerk, I live in MS.

Small Claims limit in Mississippi is $2500.00.
If your claimed amount is less than that, small claims is the way to go. It will save you a LOT of money and probably get heard faster.
