Due to father's overwhelming medical bills, parents (74 and 65) have gone into debt during past four years using credit cards to pay for meds/living expenses. Father is now two-time stroke/heart attack, homebound invalid. Father was served today for one of the CC companies seeking a judgment against him alone (not my mother) for about $14K. What exactly can they get? Parents don't work, only income is social security, own home outright which is homesteaded, and couple of older vehicles. No other assets. Also, mother is power of attorney for 90-year-old, sister-in-law and joint bank account holder. If they get this judgment, can they place a lien on the home? Can they attach the joint bank account with sister-in-law? If a judgment is placed on one or both of them, does this attach only to them or their property as well? If the judgment is attached indefinitely, once they pass, will their homestead be encumbered? Advice on course of action? I have filled out a response to be filed at the county courthouse. Can I appear in court as his representative since he cannot appear? Any chance of this not going through? Thanks for all your help.
