Here is my dilemma I have numerous medical bills that I can not pay some of them I have been making monthly payments to. My worry is that with no job right now I am going to be taken to court. If there is a judgment for the creditors in the state of NC they can sieze property from my home. But I really do not own anything my husband owns the car and some other household items from before we were married. Can they go after his things as well?

2) I only have household furnishing that are years old can they take that as well?

I am terribly worried out of my mind and do not know what to do, I do not go back to work until January.

While it is true that they may sue, the probabilty of them suing before january is not that great. They would likey harrass you for a few months before going that far.

No. NC is NOT a community property state.

Probably not. There are exemptions from judgments just like in bankruptcy. In NC, the exemption for personal property is as follows:

Household furnishings - household goods, wearing apparel, appliances, books, animals, crops, or musical instruments, that are held primarily for the personal, family, or household use up to $3,500 for the debtor plus $750, but not to exceed $3,000 in total, for each dependent.

The value you use is garage sale prices. Surely you can exempt all your things for $3500 ??
