Fuad and I have another Judgment Debtor Examination soon and we would like to know what documents we can request and/or order the defendant Bobbi Jo to bring to the exam and allow us to view, for example: her paycheck stubs and check books, but I am not sure of what else we have the right to view, so if you could just please give us a list, we would really appreciate it! My response:

Yes, Shannon.

Look closer at the questions. The types of documents you can subpoena are right there. Also, these are the "Interrogatories" that you should serve on the Defendant PRIOR to the hearing. Then, when you get your responses back, then subpoena the documents to trial.

IAAL,I was told what the new wife or husband made was not at all included in the factor of child support, This is what she is asking, i am assuming.

In the year 2000 Bobbi Jo named Fuad the father of her child. Fuad believed that he was the child's biological father and therefore he did not contest to the paternity of the child when Bobbi Jo and the Child Support Recovery Unit ordered Fuad to pay not only child support, but delinquent child support as well. Soon after Fuad began his child support payments, Bobbi Jo began to deny him any visitation with the child, Fuad then requested her to have a paternity test performed and she refused. Fuad had no other option but to hire legal representation and Bobbi Jo was ordered with a paternity test. On August 03, 2001, only 7 days before the child turned a year old, Fuad received the paternity test results proving him NOT the biological father of the child. Fuad's attorney then disestablished paternity between him and the child, terminated all child support obligations and income withholding orders and Fuad was removed from the child's birth certificate. In the year 2002 the Child Support Recovery Unit claimed that Fuad was a delinquent parent and owed back child support. Fuad realized that the Iowa Code 600.41B states that if paternity is overcome and the alleged father is proven not the biological father of the child the courts shall enter an order which provides the following:
a. that all child support obligations on behalf of the child be terminated. and
b. that any unpaid child support due on behalf of the child be satisfied.
So, since the delinquent child support should have been satisfied without his request of satisfaction Fuad requested a Nunc Pro Tunc to revise the order and was denied by many judges. Fuad's attorney explained to him that if he would like the delinquent child support satisfied he would either have to file a petition to satisfy delinquent child support, request that Bobbi Jo satisfy it or he can just pay the delinquent child support. Fuad decided to file a petition to satisfy the delinquent child support and presented the Iowa Code to the judge and the delinquent child support was satisfied. Fuad also filed a claim in Small Claims court against Bobbi Jo for Wrongfully Collected Child Support and won a judgment for $2,500.00.

NOW, Bobbi Jo is married and is pregnant with her third child after having her first child only in 2000, wow!
So, can we request an order against her husband and collect our judgment through his wages or account? Thanks, Shannon
