Judgment "fees"

A collection agency sued me for $1,674, which I was able to reduce to $972 the amount of the original debt, because they could not show how they had calculated such an amount. The judge awarded $972 plus interest (on judgment, I assume, at 9% for NYS). The agency called the other day to set up payment arrangements, and gave me 2 options. The first is $94.66/month for 12 months, totaling $1,136. The second is $181.52/month, totaling $1,089.11. I asked why the totals are more than the judgment amount, and he informed me that it is because of "filing fees" to collect the money from me, and court costs. I was at my court date, and I only heard the judge say $972 plus interest. Does the winning party always get court costs? Also, are extra "filing fees" of $164 or $117, for collecting the money from me, normal or even legal? Should I ask for a copy of the judgment before I sign their stipulation? Any info. is appreciated! Thanks!

If the judge didn't include the court costs and attorney's fees in the judgment, then they can't just tack that on themselves. Only the judge can award those fees.

You need to get a copy of the actual court papers and find out EXACTLY what the wording is.

The judgment is a public document - go to the courthouse/clerk's office and get a copy. Once you do, look to see if "costs" were awarded with the judgment (they very commonly are). If so, look in the file for a "bill of costs" and that will give you the total amount extra that can be collected.

I very definitely will get a copy of the judgement, and appreciate your help! I understand that interest is accruing, and want to get this paid ASAP, yet I want to be sure this agency isn't trying to tack on bogus "fees". I can't help but wonder if they're a bit ticked about not getting the exorbitant judgment they were asking for. The CC limit had been $500, until the interest mounted up to charge off, ending with a high bal. of $972. This 3rd party collector was trying to collect $1,674!! So, I wondered whether they thought maybe I'm ignorant, and could try to collect as much as possible without raising any flags, so to speak. Thank you all very much!!
