Judgments after BK

What is the name of your state? California

My husband and I filed BK in Jan 2003, Discharged May 2003. We did this because we were being sued by a cc company for $17.000.00 in debt. I gave the summons to our attorney, he said he would take care of it. Well I have found that he did nothing about it. The BK was discharged and now I have a judgment on my credit report. What do I do now? not only do I have the BK now I have this judgment. Can I get this off because it was discharged in the BK or what?

Need some help, we are working on getting a new home and I need to take care of this.

Was this debt included in your creditor matrix??
Was this debt included in your discharge??
Also, what chapter was your petition??

I am not sure what you mean by "Creditor Matrix" But It was on the Discharge papers "Schedule F Creditors Holding unsecured nonpriority Claims sheet. And it was a Chapter 7 Bankruptcy case.

The creditor matrix is where you list all your creditors holding the debts you owe. If the judgment creditor was on that list, then the debt was discharged.

So, what you need to do now is file a Motion to Vacate with the court that rendered the judgment, your reason for is the debt was discharged in bankruptcy. Once they motion is granted, the judgment is null and void. Wait 30-60 days, then dispute the judgment with the credit bureaus, you will probably get it off.
