What is the name of your state? Georgia

Someone bought an item from me just to leave me negative feedback to ruin my reputation, that I "Sent him naked pictures of myself, worst ebayer ever, beware". He's from another state. It's my understanding that since he came to ME, by coming to MY auction to leave me bad feedback, that I can sue him here in Georgia. Is that correct?

Next is, anyone know the correct wording to use on a court complaint? I think the words "with malice" should be on there, and that he and his ebay user name, are one and the same person.

Lastly, anyone know what monetary damages might be in order? Our small claims court goes up to $15,000, don't know what a court will ultimately award.

Thanks,

J

Small claims courts will not hear a libel complaint, you will need a higher court if that is the sole basis of your lawsuit. Small claims only hears cases for actual monetary damages, what are your damages and what proof do you have? And what did eBay tell you when you asked to have the feedback removed?
