What does a prosecuter have to have in order to take a case to a jury trail?

There was a 911 call for domestic violence
police findings were nothing but an argument
(no physical violence), yet he arrests the male, and later is released with a $1000 bond, and charged with 4th degree assault, prosecuter findings only argument(no physical violence) no criminal background on either party. Can he proceed with a jury trail? Please respond Thank

The DA has more -- a statement from the other person that s/he felt the guy was going to hit him/her. That's assault by intentionally putting someone in fear that you're going to hit them.

Assault=
hitting someone, or
trying to hit someone, or
intentionally putting someone in fear that you're going to hit them .
