I live in California and I have a question as to what the punishment for an infraction of the law might be. About a month ago, I was pulled over for driving 30 miles per hour in a 35 zone. I was then charged with violation of code 12814.6 cvc-violation of provisional license. I am only 16, and I had 3 of my friends in the car without my 6 months granting me the right to drive people under the age of 20. Also, it was the night of the time change to daylight savings time, and although we all thought it was 11:30 due to the time change, the times apparently don't change until 2 a.m, making it 12:30. This was another breach of code 12814.6 cvc. I have been ordered to appear in court, and I am wondering as to what kind of punishment I could possibly receive in this case.

I appreciate your help.

You don't want to know what I did when I was your age....

Anyway, ask for a diversion program. That's where you have to go to school or lectures or whatever and, if you do everything right, you either get reduced charges or they go away altogether.

You don't sound like much of a criminal to me! :D

Well, me too, but my understanding is that provisional drivers are dealt with rather severely in terms of getting their regular license when there's ANY sort of violation.

You may not be able to get it back until you're 18 - but I'm not in CA so don't take that as gospel.

In Missouri, there is a major difference between having your license suspended and revoked. (Think in$urance.)

Find out about that too....

I have court early tommorrow morning-and I can't help being extremely nervous, even though I feel I didn't do very much wrong. Kids do worse things than drive their friends at 5 miles under the speed limit.

They got tired of carloads of teens slaughtering themselves because they were inexperienced distracted drivers. We won't even go into thespeed and substance related vehicular deaths.

Uuuuh, and driving their friends when the law restricts that, as well as driving after the allowable hour. If you can't show the maturity to follow the law as a brand new driver, why do you expect the state to allow you the right to drive?
