Hi, a few months ago my mother sold her house. about 4 months after she sold it the new owners sued her for breech of contract
because she took 5 plants out of the yard. after we got in court, they turned everything around , instead of 5 plants it turned into 30, and instead of just plants it turned into light fixtures, ceiling fans air conditioners, and i mean just some crazy outrageous stuff. my mom confessed that she took 5 plants but nothing else so the judge awarded the couple 1,600.00 my mom filed for slow pay, she went to court on the slow pay, and we she got there, the couples lawyer said that she wasn't down in the docket and he would call her to set up payment arrangements. about a week after that, my mom got a card saying for her to come to court , so she assumed he didn't want to settle things over the phone , instead back in court. so she went, this time the couple was with the lawyer. come to find out, they appealed the 1,600.00 and my mother had no idea. the judge didn't set another court date, instead he told her he would recess for 45 minutes for her to get witnesses. they sued her this time for 4,500.00 for landscaping. the couple had already divorced by this time, and rumor had it they were losing their house. they won the case. my mom done some checking and come to her surprise, the landscaper they had come to court, wasn't even a landscaper! my mom had a check done on the house they purchased from her, and come to her surprise again, the bank foreclosed on them the same month as the court date. and they never once made a payment since they had been in the house. I have talked to one lawyer, and the lawyer said that in general sessions court, (which that is where the first court date was at for the 1600.00 ) you only have 10 days to appeal. if that is true, then how did they appeal it after almost 3 months?! and why would my mother have to pay for something they lied about,( which we have proof, but the judge won't listen because my mom can't afford a lawyer) and pay for something they don't even own? We believe their intentions were to sue my mom to make house payments. is there anything my mom can do? I know this is a very long story, and believe it or not, it has a lot more to it, but she really needs help. We live in Tennessee, and no one will help us. I know there has to be something we can do. I 've heard of some crazy stories about people being sued over stuff, but all we want is justice! please help, we need someone's advice!!!!
