Just cause for quiting

What is the name of your state? WV.

I figure I know the answer to this..but..
While I was on vacation, my employer hired another person for my position.
Then calls me and says that I dont have my position anymore...but can still work..but for 10+ less hours a week and $3.00 less an hour...
Do I have a just cause to quit??? I can not live and pay bills with less income. and want to know if I can collect unemployment while I look for a new job?

You can quit anytime you want. As far as unemployment goes, you usually don't get it if you quit. I have heard of such a thing as parcial unemployment where if you can show you were making xx amount and then got cut down to yy amount you might be entitled to something. I don't know what states have that or exactly how it works. Maybe someone else can answer that.

generally you are not required to accept employment significantly different or at a much lower pay than your previous job. This question would be best answered by your local unemployment office as they will be the ones making the determination of your eligibility for benefits.

Ok..I called the unemployment office. They said that it is not just cause :( but could quit and still get unemployment..but will be penalized 4 weeks. Which still sucks..but would be more in weekly benefits then continuing to work for this employer at the rate he wants..even counting the 4 week penalty

I'm in Ohio, and here we have to wait 4 weeks as well. I'm not sure that it is a penalty, though.

I fixed it, sorry.

I was simply saying that unemployment doesn't pick up the moment you are unemployed. There's a waiting period of sorts here, too.

Yea that is the penalty ..is the four week waiting period... in wv.. I live in Ohio...but the employer didnt pay ohio unemployment...only wv...So I was told.

But the unemployment office said to file today..so the four weeks could start

According to West Virgina unemployment site there is only has a one week waiting period, not four weeks and if you are partially unemployed when you are hired as a full-time employee, and you are still on your employer’s payroll, but that employer cannot give you full-time work.

And, just fyi, if you worked in WV, that was the correct state that your wages should have been reported to for unemployment tax purposes.

And unemployment is not going to pay you what your old wages were; you might end up with significantly less than you would if you stayed on the job.

i understand unemployment are not going to pay what my full wages was... but after the cut in hours and the cut in pay... I would bring home about $140 a week after taxes...
and unemployment should be about $208.00 ..based on average of pay. Before tax.

Anywho... Thanks for the advice... working with the unemployment office now :)
