What is the name of your state (only U.S. law)? PA

My daughter and her husband are going through problems. She left her husband after years of abuse (she is living with someone else) they have three children. The youngest is living with her. The two oldest are with the husband ( buying everything they want is a big influence :rolleyes: ) They have gone for custody but the judge wanted to wait until the middle child was evaluated (psych problems) ..Well after 6 months my daughter finally got an appt with a psych for the child. The kid calls her yesterday and asked her what the appt was for. After she told him/her he/she said " I'm not going" So she talked to the husband and he said "if he/she doesn't want to go he/she doesn't have to" She called the school this morning to get him/her out early for the appt and got the response " we can't give you the information if the child is in school or not. You will have to come here" My daughter just called ..the child did not come to school today..Dad called her/him out sick. So she got a note from the principal stating the info along with information about his grades, how many days or sick the child has missed. She is doing the same with the oldest child, getting the info from the school.
I guess my question is...can the mother (my daughter) get temp custody from the father since he is hindering this childs welfare ? Since it has been quite a while since the two have been with the father will this hinder the mother from getting primary custody in the end ?
I have to add that a home visitation was ordered but hasn't taken place yet. After what the father has done so far I imagine that he will put this off as long as possible also. If my daugher files for emergency custody would this change anything ?

When you say, she is living with someone else, do you mean a new boyfriend?

She left abusive husband to move in with...who exactly? Boyfriend or girlfriend? Relative?

Yes she is living with a new bf...(Not what I would have wanted her to do ) in a 3 bedroom house so the kids have a room to themselves . Her soon- to -be ex husband has a girl friend also. She has a child too.
He is living with his mother, father, sister, two nieces and a nephew.

She didn't "leave" the kids with him. She left the house they were living in. Told the husband as long as he paid the bills she wouldn't press the living arrangements. ( a place for the kids to be comfortable ) it ended up when we took the kids on vacation the kids came home to a house that was emptied out ! She wasn't going to force them to go with her. The husband was only abusive to her not the kids. He has the kids living with him because he is "buying" thier loyalty. She told them no to a dog....dad bought them a dog. No to a 4 wheeler because the previous one was stolen...he bought 2 of them. After he moved everything out he traded in the 4 wheelers for dirt bikes. So the kids know if they go with thier mother they won't have these things.

I guess you could call him her boyfrend.

Children exposed to abuse are just as psychologically harmed as if they had taken the physical blows themselves.


She left the kids with him...the man they watched abuse their mother for years.
