What is the name of your state (only U.S. law)? NJ

My pay day is every 2 weeks on a Friday. I am new just a month. Today is my 3rd payday with them. I work 6 hours a day. The last 2 paydays (and looking like this one too) I don't get paid on payday I get paid the following Monday because my bosses come back to the office long after I am gone to sign checks. This payday it's more annoying becuase 1. why do I have to wait 3 days more than everyone else and 2. I have rent tomorrow. I can't stay past 2 because hubby has to leave as soon as I get home for his job & we can't leave kids alone. Is this legal? It seems that if they know I leave early they should have a check waiting for me with my supervisor or come to the office earlier.

Agreed. The check would be available if you would go get it.

If the employer offers direct deposit, enroll and your problem is solved.

There is nothing in the law that requires them to have the check available when it is convenient for you. You are getting paid late because you are not making yourself available when the check is ready. The check is available to you on payday. You're just not collecting it then.

The employer is violating no laws.
 
Thanks! I would drive there or have hubby get it after work however he is out by 11pm and they are already closed. I wish they had direct deposit, trust me, but they are brand new and we aren't even employees yet, we are all 1099. I figured since they go in the day before payday to make out their own checks they would be nice and do mine too since they knew from my interview I couldn't stay past 2pm & they wouldn't be in the office that early.

Oh well..thanks again...learned something today.

The (probable) misclassification of you as an IC instead of an employee is a whole 'nuther ball of wax.
 
Yeah according to the IRS website I do not qualify as an IC but it is a job and UIB ran out so I am stuck for now. You think that is a doozey....they have agreed to not issue 1099s to other vendors who refuse to do business with them if they are forced to fill out a W9. Not sure how the IRS will feel about that when they found out!
