Just learned of foreclosure

What is the name of your state (only U.S. law)? Michigan

I just recently learned that my home is being foreclosed on and will be sold at auction on April 30. We have been in contact with our mortgage company and have told them that when we received our taxes we would make the loan current. And was mailed papers that stated that our federal refund would be taken (which was fine). Today my wife checked our bank account and saw that we had money that should not be in there and attempted to call to make the payment over the phone and was informed of this. We have not been served an actual foreclosure or received anything in the mail with the exception of a debt collection form. Is there anything that we can do to reverse this? We have the amount to make our loan current but was told that it didn't matter. Is this the case?

Was a court case filed against you at any point? The mortgage company cannot sell it without a judgment.

To my knowledge, no. We haven't received anything of the sort. Would this be a hearing that we would attend or something that could just be filed and awarded?

No "court case" is required in Michigan. Most properties are foreclosed through non-judicial means. "Service" isn't required. The requirement is that they publish for four consecutive weeks and within 15 days of the first publication, post notice on the property.

Claiming you intend to make your loan current usually isn't enough to stop it.

Thank you Ron. I fully intend on making my loan current. If I just paid it up to make it current would that stop it? I know they can't just take my word for it but I also do want to pay it when I could/should be using that money for a new home for my family.
