Just need opinion

What is the name of your state? Gulf of New Orleans, LA

I am getting ready to go to hearing officer meeting on the 5th. My x is trying to gain custody of my daughter because of the hurricane. (I have posted about this before, but I have a diff question). His allegations are false or exaggerated, such as there is no potable water, which there is. It says I moved her around too much in the last 6 months, which also is not true, I moved around because I was fleeing from a hurricane and couldn't go home. I am in the process of rebuilding, ins clm done, waiting on alot of things. How likely is a judge going to take custody from me because of a hurricane. Its temporary, and every child in SE LA is going through it. SHe is back in her old school, and just made straight A;s. She is 6, BTW. I can't see a judge allowing this, but I don't know if it has ever happened before. Can I get some opinions. I feel like it shouldn't happen, but I know that doesn't mean it won't. Thanks in advance.....

No one can tell you what will happen.

The judge will look back further than the hurricanes to see how fit both of y'all are doing.

I just wanted to wish you luck! I'm originally from New Orleans, and 99.9% of my family lived in St. Bernard Parish and have had to relocate due to the levees flooding their homes... Hopefully everything prior to the hurricane would be in your favor, you have no control over mother nature. At least you still have your home, there are so many kids who were left without a home to come back to after Katrina left!! Not that anyone can predict the outcome, like Seniorjudge said, but one would hope the judge would understand how beyond your control the situation was.

I origimally from ST. Bernard Parish. I am fortunate I have a house still. We only got a foot of water, I am in Metairie. I moved from St. Bernard Parish. My father and grandfathers stayed for the storm and swam out. The water was over their roof, they are staying with me for now. The poor chalmations and st. Bernard, it soo sad. There are still cars hanging from roofs, there is debris in tree branches. It still looks like a bomb went off there. St. Bernard is falling through the cracks, everyone focused on New Orleans.

Thanks for the advice. My x is in NY. Before the storm everything was cool, he gets majority of summer and alternate holidays. Everything he is alleging is since the hurricane, even though he words it as 6 months. I only had her back for 2 weeks before the hurricane hit, she was with him 6 months ago. As most children it is hard at exchanges, but I stay strong and tell her that I want her to go and she needs to do this. It makes it easier on the child if your strong.

I am scared that I might loose custody of my daughter, there is always that chance. I just hope that the judge will see this for what it is, I am sure he is going through the same thing. Thanks..

The judge will look @ how fit you are, before the hurricane & now. If you have a place to live, food to eat, etc and it sounds like your daughter is doing well, you should be OK.

From what I hear, judges here are not taking too kindly to NCP's trying to use these hurricanes as an opportunity to try and take custody from fit CP's just because they believe they now have one up on the CP.

btw, i'm also from louisiana

I know it is falling through the cracks from talking to my cousins/aunts and uncles... we fortunately only lost one person, and that was a cousins brother in law, it could have been worse. But everyone was able to get out. This isn't the place for this though :cool: Feel free to pm me or email me through my profile...
