What is the name of your state? Indiana

Almost a year ago my oldest sons mother was arrested for possession of paraphenalia and cocaine. My wife and I discussed this with her and we were told that the charges were dropped. We were just told by her sister that those charges were not dropped and she is now on probation. When this first happened CPS went in but since she is living with her family they said they would let it go this time. Financially we can't afford an attorney so we don't know what to do. We were also told that she has failed 2 tests since being put on probation both times for cocaine. We know he would be better off with us but don't know how to go about doing it. We are considering calling CPS again but are just so confused and don't want to traumatize him. Any suggestions?What is the name of your state?

I don't know that there is much of anything that you can do at this point. If she continues to fail her drug tests then she will end up in jail, and then you will have the opportunity for a change in custody. The problem is that you have been "told" she has failed tests...but you don't have proof of that.

However, go and at least get a consult with a local attorney (or an attorney in mom's area if you don't live locally). That would at least give you a better feel for how the judge's in your area tend to rule.
