Is $5,000 a small claims court case?
The statutory limit for filing a claim is $7,500 in small claims for CA for a natural person (i.e., not a business), if that's what you're asking.

Whether or not the subject matter is subject to small claims jurisdiction is another thing entirely.

And why would you say this has nothing to do with a child, anyway?
