I am trying to help one of my son's friends. We live in a community where golf carts are one of the main forms of transportation. The high school has limited parking for students who drive to school on thier golf carts, so some of them park next to a cart path near the school. My son and a few of his friends where in that area waiting on another friend. One of the kids moved a golf cart about 15 feet from where it was originally parked under a tree so they could park my son's cart there in the shade while they waited. The school cop just happened to pull up while he was moving the other cart.
She wanted to charge him with "grand theft auto". However, I believe the formal charge is "The felonious taking and removing of another's personal property with the intent to permanently deprive the true owner thereof"
Having said all that, my question is: can this charge stick even though the owner of the cart is not pressing charges?
His court date is the 2nd of September and his father is trying to decide if he should hire an attorney. They have limited finances although they did not qualify for assistance.
Any input in regard to this matter would be greatly appreciated.
