I have a question regarding a juvenile that I know. He was charged with a sex crime. When questioned by the police, they interrogated by the police in the police lunch room. Then, when he was arrested they did not read him his Miranda Rights. He then was placed on house arrest where he was not told he could not go outside. When they arrested him for that, they did not serve him with a warrant. Is there anything that can be done? They have already spent $19,000 in attorney fees and have run out of money. Please help!

he was charged with a sex crime. was he convicted? when they place him on house arrest, was he still under the impression he could still do whatever and go whereever?

so now he seems to be in violation of his house arrest.

looks like juvie hall to me.

as I recall from a recent post, on the topic of performing the Miranda Rights reading, this is ONLY required during a formal interrogation, eg. at the Police Dept. or other official investigation room, where evidence is recorded through a meduim such as video or audio. If your friend willingly submitted to an investigation in the lunch room then there was no basis to 'mirandize' him. Unfortunately for him, he's probably facing some time, on the basis of a sex crime, depending on the severity.

How do you know he was not served with a warrant at the time of his second arrest? Were at the house at the time the police came?

If he was placed on house arrest, "no" means "no", any violation of that would clearly be an arrestable offence in most jurisdictions.

$19,000 in attorney fees all for the same original accusation or...?

I dunno dosent sound good... :confused:

A long story!

I know that he was in fact at the police station at the time of the interrogation, but was not informed he was being interrogated. They were in the lunch room at the time because the police station was under routine maintenance. He was outside all summer and his probation officer, I guess it was his probation officer knew of him being outside and never told him otherwise that he could not. The head of the juvenile probation was on maternity leave, and when she came back, she found out that almost every juvenile was on their front porch, and told the visiting probation officer that they could no longer do so. Anyway long story short, he has not been convicted yet and is supposed to stand trial for this in about a month. His family has been going through hell and back from all of this. He is a good kid and I think he is being wrongfully accused by the other family because the two families don't get along. I know both families very well and I think this child is paying the price for the adults quarrels. I really feel bad for the children involved, in both sides.
