What is the name of your state
Maryland/Washington DC

I am considering taking a job that requires me to get a TS Clearance. I was
charged as a Juvenile for recieving and concealing stolen money. I was put on
probation, but I violated my probation and was sentenced to serve time in a Juvenile federal correctional Institution, which I served 13 months. since then I have had no arrests, I am now 47, married two kids and lead a productive lide. I understand that a new law was passed
that automatically disqualifies you if you were charged with a US crime and serverd more than a year in prison. Does that include juvenile records as well?
Should I be concerned with this? Do I have to tell them about my incarceration? I was told that I never had to admit it when applying for a job, and I never have. The Federal court said that it would be sealed.

Q: Do I have to tell them about my incarceration?

A: Yes, you should be the one to tell them.

By the way what is "a Juvenile federal correctional Institution"?

How old were you when you were sentenced to that place?

What crime did you commit? (I know what you said in your post...I mean the details and facts.)

It's a Federal Correctionl Institution. I was charged at the age 15-16 for receiving and concealing $500 that were given to me by some Juveniles that
stoled it from a bank. I was given probation, but violated it because I didn't attend school and a couple of other misdemeanors.

Okay, gotcha....I'm getting tired.

Anyway, YOU tell them. One bunch of feds already knows so you should be the one making the disclosure.

If you do not and you are found out, you will be in deep, serious trouble, not to mention losing your job.

Think Martha Stewart....

Also remember that depending on which agency/organization you wind up working at you may also be required to take a polygraph so even if you do lie initially you might get snagged during that process.

Tell the truth.

Right, I appriciate your advice, but I need to know will what I did as a juvenile
keep me from getting a clearance. They keep saying that they are concened with the last ten years for a TS. This happened another life time ago, 32 years.

I understand. but I am not lying about anything. They never ask the question have you ever been Incarcerated. Anyway my understanding is the TS only goes back 10 years. this happened 32 years ago.

Its been awhile since I worked on my SF-86, but I thought in that paperwork it asked about criminal activity... (But it may specify activity in last 10 years I really don't remember). In anycase you won't have much to worry about since you were a juvenile and it was so long ago.
