I am a teacher. 3 years ago I was arrested for domestic violence. The charges were dropped. However, the FLDOE decided to pursue the matter and make me pay some sort of consequence for actions unbecoming to a teacher. The arrest had nothing to do with children or my job. The result was that I was reprimanded and that I had to see a psychologist for him to determine whether I was fit to teach children. I went to the psychiatrist and did some basic tests. However, his evaluation letter stated that at the time of my arrest I was drinking and taking xanex. Luckily, I was allowed to read his evaluation before he sent it out to the FLDOE. I called the doctor and he said that he based that information on a document he received from FLDOE. I have never taken a xanex in my life. There was other information on this document that stated that I had blacked-out and told co-workers that I wanted to kill my principal. The FLDOE had sent the doctor someone else's evaluation from another incident. Is this libel? There has to be some sort of law about sending false information. The FLDOE would have used this information in my general files with employers, if they already haven't.

You have no damages since you werre able to correct their stupidity before it affected your job. They are idiots, but they don't owe you anything for it.

No. You suffered no damages and they didnt have a negative intent behind it. They made an honest mistake and it was corrected.

I'm not so sure the false document hasn't affected my job. I was recently asked to resign in lieu of dismissal from a position I had for two years. I am a Special Education teacher and Special Education teachers are hard to come by, especially in Florida. I know that the dismissal had nothing to do with my job performance as teachers are evaluated every year and my evaluation was very good if not excellent. Because I had only been teaching there for two years, I did not have a continuing contract and the principal did not have to give me a reason for dismissal, and she didn't. She did however, write a wonderful letter of recommendation for me as did my immediate supervisor and fellow colleagues. I tormented myself about why the school did not want me working for them. When I saw this document, I realized that if I was a principal and I found out one of my teachers had threatened to kill a previous principal, I would not want that person working for me! Would you? The principal knew about my arrest 3 years ago when the FLDOE started their proceedings against me. She backed me 100%. She was even going to testify in my behalf, but it wasn't necessary. So my arrest had nothing to do with my dismissal. It has cost me quite a bit of money to move to another county so that I can get a job. My son has had to leave his high school in his junior year. This doesn't cover the humiliation and the torment I put myself through and the loss of friends and good colleagues. I had to pay a psychiatrist $700.00 for an evaluation required by FLDOE. Insurance would not cover it. Teachers are held responsible for their actions/mistakes. I have personally felt the wrath of the FLDOE. Maybe it was an honest mistake by the FLDOE, but why shouldn't they be held responsible for their actions?
