My Son leased an apartment 4 yrs. ago with his fiance, my son's name is 1st on the lease. They are breaking up, and he decided to stay with us for a month until she could get her things out. When she did not move, my Son told her he was moving back in, and she could either move out or sleep on the couch. When he went to the apartment on the appointed day, she had her parents there, and they told him he could not come in. He had paid the rent for that month, he has the receipt. My son called the police and the officer told him he could not move back in. There was no hysterics or danger of physical threat to his ex. The Hawaii Revised Statute says that a police officer can prohibit one from entering their residence if there is an imminent threat of physical abuse. That has never happened nor is there any police record of any past abuse, was the officer wrong, and how can my son take possesion of his apartment?
