kidnapping?-Whats my rights

I need some info for my friend in IL. the story-- She left with their 2 mos. old son out of state. No note no anything. He tracked her down in another state. Shes only 18 years old -no job-no transportaton-no income-no home-no ged to better herself. He has secure employment, owns a home, has transportation and has the means of supporting this child. Also has plenty of friends and family. Since she has left she has made no voluntary effort to contact the father of the wellbeing of his son or even where he is at. Has no knowledge if the child has been seen for any medical reason or whos care his son is in if by chance she sought employment!-My question - what legal ground does he have to stand on ? Is this kidnapping? Does he have good chance of obtaining sole custody if he wishes to seek it due to the facts surrounding the mothers current situation? Does he have grounds to prove her unfit based on the fact she has no stable environment for the child and no means of supporting herself or the child at the present time that we know of? Since she is now out of state can he file these proceedings in the state he lives in or does he have to file in the state she is at. I need legal info so that he knows where he stands. thank-you!

He may be able to prove her unfit if he can find her and prove that the child is being abused,neglected or in someway not properly taken care of!As far as kidnapping goes,no he cannot file any charges for kidnapping.They are not married so most states very the bio mom to be the person to have custody of the child!And depending on how long it takes him to find her,he may have to file in the state that she is living in now!Good Luck!!!
