ok so im not with my sons father i work he doesnt he doesnt give money or see them. i wont let my kids go over his house which is his mother and fathers house cuz they all smoke weed and sell weed and do many more inappropriate things in front of them. i told her they can see them in my home. she is threatening to take me to court what are her rights?

Is he legally established as Dad? Is there any court ordered visitation?

she has no rights at all. let her threaten all she wants, she wont get anywhere.

Oregon does allow grandparents standing to sue for visitation if certain conditions are met - thus the questions asked of OP ;)

Grandparent Rights to Visitation: Chapter 109, Section 109.121 (O.R.S. § 109.121). Grounds: Visitation may be granted if the grandparent has established or has attempted to establish ongoing personal contact with the child and the custodian of the child has denied the grandparent reasonable opportunity to visit the child. Chapter 109, Section 109.121 (O.R.S. § 109.121).

When Adoption Occurs: Visitation rights terminate upon adoption.

Child Custody Statutes: Factors: (1) emotional ties between the child and other family members; (2) each party's interest in and attitude toward the child; (3) desirability of continuing existing relationships; and (4) any abuse of one party by the other. Conduct and lifestyle are only considered if it is causing or may cause emotional or physical damage to the child (this will require strong proof). O.R.S. §§107.105 & 107.137.

Standing to sue isn't a guarantee of a win. If dad lives with grandma and hasn't established his own rights, that is even less of a guarantee for grandma to win.

Grandparents often believe that they have "rights" that really don't exist.
