What is the name of your state (only U.S. law)? PA- My daughter and her husband have recently split up. She left the residence and told him she had no problem him staying in the house as long as mortgage/bills were paid. They have three children so this was a place the kids could stay with thier dad . The deed is is Daughter and her fathers ' name. The house was purchased before they were married. Saturday my daughter went over to the house and it was cleaned out, all furniture was taken her husband said it was put "in storage" . The police were called because of problems and the officer told my husband he COULD NOT enter the house because he was only the "landlord" and if the daughters husband didn't want him in he wasn't going in. He told my husband that he hasn't paid the mortgage either.
My question is......Now that the house has been "emptied out" can my husband enter the house to make sure there isn't damage done other than trash in the house ? Do we need our daughter to be there if we do go in ? Would we be able to change the locks ( with daughters permission ) so her husband couldn't go in and do damage ?
Thanks for any information.

Ummm OP's daughter and OP's husband.

OP since it was the marital residence and it has been abandoned by the husband then your daughter can go ahead and change the locks.

Where did the cop get the idea that the landlord could not enter his own property? Besides your daughter has just as much right to the property as her husband and could have allowed him to enter if she wished.

The deed is in my husband and daughters name. My husband signed a paper so they could get a loan to consolidate thier bills and pay them off. So the loan/mortgage is in Daughter and son- in -laws name. The deed was never changed out of the origional names.
I have to add that my daughter did move out so he could stay in the house because she had a place to go. This was so their kids had a place they could feel comfortable at. Now son-in - law is staying at his mothers a 3 bedroom twin with 4 adults , 2 children, and 2 , make that 3 dogs. (but that is another legal area) so when he has his kids that will be 5 adults and 5 kids in that one house.

Thanks for the info.
