One year ago I was injured during a training exercise as a lifeguard on the coast for the State of NC. I torn the medial meniscus in my right knee. I had no problems with workers comp, they paid me benefits and covered all ensuing medical expenses including my surgery. The doctor released me as not being disabled. During the last year i had several problems with my knee, nothing major enough to seek medical attention. Recently, however, the same knee is giving me problems. I believe that i have re-aggrivated the same injury and that it was never fully recovered. The insurance provider disagrees, stating that this was a new and seperate injury. I no longer work for the State of NC and haven't since the initial injury. I was wondering if there is a claim here for a possible monetary settlement against the State of NC or the insurance provider, because it is obvious that this is infact the same injury, it was never fully recovered. Would there also be a possible suit for pain and suffering or the decline in quallity of life, since I am an active person and can no longer participate in many activities? Please help.
