L.A and Boston, Divorce? help Please!

What is the name of your state? California

My step-father currently lived in Los Angeles, CA. And my mother recently moved to Boston about a month ago. If my step-father file the lawsuit that he wants to divorce with my mom. Does my mom has to fly back to L.A and sign the papers? or my step-father can mail it to her and she can sign it in Boston?

What if my mother file the divorce lawsuit first at Boston? Can she just send all the paperworks to L.A and let my Step-father sign it?

Do they have to go court if both agree to divorce? what happend if just one side agreed?

Your mother has to attend court or it becomes a default and step dad gets everything he asked for.

Your mother cannot file in Boston because she has not lived there long enough. Also your stepdad can argue jurisdiction because he has not lived in Boston at least when it comes to property unless he willingly consents to the jurisdiction of the Massachusetts courts.

Any agreement they make has to be approved by the court. And if "just one side agreed" then you don't have an agreement. You have a demand. It takes both sides to have an agreement. Thank You very much,

So someone should make the trip cross country for the divorce and it will probably be your mom if she wants this over soon.

Thank you Ohiogal, the problem is, my mom doesn't wanted to go back to L.A. Can she just sign the papers in Boston? I mean they don't really have any property to divide. Also how long it takes for the court's dicision arrived?

Your mother could certainly sign any paperwork that your stepfather prepares....but its not very wise to not show up for court. Wierd things can happen if one of the parties doesn't show up for court.
