Lady I noticed you answered the person with this answer, I also have changed bank accounts to only me,
what do you mean by non-exempt assets,

and we have a mortgage on our home, In Texas can a lein be placed on the mortgage and for how long

Also I have an employer very willing to work with me can they also move to garnish my wife bank account since you stated that In Texas everything is half?





If you do nothing, they will get a default judgment against you. Once they have a judgment, they will move to collect by any legal means they can. Wages cannot be garnished in TX, so that is not a concern for you even if you had a job. TX has a 100% homestead exemption, so they cannot take your house from you. However, they CAN sieze your bank account(s) and drain it dry, so if you have joint accounts, you need to get your name OFF those accounts NOW. They can also sieze any non-exempt assets you may have, and keep in mind that you ARE in a community property state, so anything that you have acquired during your marriage is 1/2 yours.
