What is the name of your state (only U.S. law)? In Texas can I get the ladybird deed myself and have it notorized an filed? Also just sent off application for 88yr old mom in nursing home the last 30 days after a fall and hip surgery to apply for medicaid. She qualifies in all areas an only has a home which the ladybird will cover but do I have to hire an atty for this deed?

Well technically, you could might be able to do it yourself, but your best bet is to pay the few hundred dollars a lawyer would want to do this. He can not only could make sure that the wording of the grant is correct (and correctly describes the property) and make sure it is filed (and indexed) properly, but he can also advise you of a few times when you DO NOT want to execute such deed.

You don't want to do this if you think the grantor will be needing medicaid in the next five years. Further one should make sure you are certain who you want to grant the remainder interest to. Unlike a will or trust, this is NOT rescindable once it is executed.
