What is the name of your state? South Carolina
We had let 3 men come in and clear out our pasture, they hauled off the trees but left us with the tops and stumps. Our problem is that while we were gone they went across our fence and cleared some of the land behind us to get additional trees. The owner of the land has now told us that he is going to sue us for the damage. Are we responsible for what these people did without our consent? We have tried to contact them but they will not return our calls and we do not have an address for them. What are our options?

**A: I do not understand the reason "to get additional trees". Did these men want free lumber, firewood or?

They make money by selling the trees and we're guessing that they did not have a full ltruckoad and thought that they could get enough to make a load by with cutting the trees behind us down.

**A: ok, that sounds logical for con men that you have no contract with and do not know how to get a hold of.

Which leads me back to the orignal question - Are we responsible for trees that these men cut down on land that we do not own since there was no contract?

OK, let me get this straight.

The tree cutters cannot be reached.

They refuse to acknowledge you or that they even did business with you.

So how would anyone know you hired them?

If no one has any proof that you hired them, how can anyone sue you?

For all anyone may know, the tree cutters decided to cut down your trees and the other guy's trees without your knowledge or permission or whatever. You can claim ignorance or innocence and no one would be able to prove otherwise.

Thus how can you be held liable?

Yes I did read the post. Here is the quote that is of interest:

If there is no proof that the owner let the 3 men come onto his/her property and cut the trees, then how can the owner be held liable? Proof may include eyewitnesses, signed contracts, written documents, etc.

Let's say the owner didn't want his trees to be cut in the first place. But the 3 men came in anyway and cut the trees without owner's knowledge. Can the owner still be held liable for this? Thanks.
