There is an alley behind my house which I wish to use to access my garage that I plan on building on a pre-exisiting concrete slab.

Currently, there is a city sewer that runs through it and the power poles are placed/located on the corner markers between properties.

In working with the city planning office, I have discovered that there was no easement drawn on the original plat (1946).

To date, there is no record of any sort of easement or dedication to the City of Westminster for the use of the sewer and power companies.

There is a house at the other end of the block (the west end) of the alley, using the same alley to access a garage that was built several years ago.

What are my options and is the city liable to me as a homeowner financially, because the easement was never legally granted???? What about the sanitation department and the power company????? Technically, from what it sounds like, they are trespassing..........

I spoke with the city planner today and he was reluctant to ask the City Attorney's office to look into this, because of the cost involved. Isn't that part of their job, as the city?????

When I pushed back to say that I didn't understand why it was my responsibility to get this straightened out, he said that he would take the plat to the City Attorney's office, and see what he could do about getting the paperwork started.

What does that mean "prescriptive" easement?

They are trying to tell me that if I want to access my garage from the alley, I have to pay to pave it up to my property line, plus I have to get "permission" from each neighbor I would pass - shouldn't that be a part of the same "prescriptive" easement that let's them put power and sewer back there?????

If this prescriptive easement gives them that kind of authority, shouldn't they then be responsible for maintaining the alley and paving it themselves????
