Landlord Allows Convicted Drug Dealer to Remain in Duplex and Threaten Other Tenants

I have recently moved my family because the landlord refused to evict a tenant that has plead guilty to two counts of possession with intent to deliver. He was sentenced to intermediate punishment for three years with one year of electronic monitoring. On separate charges of possession with intent to deliver and possession of a controlled substance, he also pleaded guilty and was sentenced to probation for three years. He was also ordered to undergo a drug and alcohol evaluation. Sentences are to run consecutively.

This tenant was our upstairs neighbor in a duplex and threatened my family numerous times because we would report his activities to the police. We filed police reports and complaints with the landlord. The landlord refused to remove the convicted individual. As a result, I moved my family away from the harrassing and criminal individual.

My question is, should I be able to recover moving expenses incurred beacuse of the landlord's failure to provide safe living conditions for my family? I do know that in most states the landlord can be held liable for the actions of tenants when other people are involved.

Any advice would be greatly appreciated.

Should you?? Yep.
Are they legally obligated to reimburse you for YOUR decision to move?? No.

I would say yes, especially since you told us that you need to move so apparently you understand that you need to move.

I am sorry but I do not completely understand the point you are trying to get across in your post. Do you feel that if I persue the matter that I have a good chance of recovery? Thanks for your time.
