What is the name of your state? Tennessee We bought our hse Dec. 15th 2000 there was a fence up in the pictures and when we looked at the hse still up and we have owned our hse almost 6 yrs. Well we just found out that the 10.3 feet of our what we thought was our propetie isn't we have planted yrs ago a huge flower bed in the corner of our back yard semi circle all the way up to the fence line even privacy fenced it now do to problems we have had with his renters he has decided to allow them to claim the propertie now mind you he has know since 1991 that fence was in the wrong place and should hve been moved but never moved it. we even planted trees in our back yard which would become theirs if he decided to allow them to take dwn the fence. What he told me today was he told them the bck yard fence stays put but they can take over the front yard which means the fence that runs from the corner of our hse and attaches to the back yard fence they can remove part of it not sure how without removing the part that attaches to our hse. anyways after knowing and allowing us and previous owners to maintain and upkeep this propertie and the realtor who sold us the hse owned it so she knew that 10.3 feet of the yard was not hers or going to be ours and not one person told us. What about the money we have spent on the flower bed and fencing and trees. Are we just out that money and they can remove it and take over or what. My neighbor told me of a grandfather law that he thought since the fence has been there since 1991 and the owner has never mentioned it or claimed the propertie until we had a issue with his tenants that they might not be able to yank it dwn and keep what we paid for. I have no clue but I do know when you are looking at propertie and the back yard is fenced would not everyone assume that the fenced part that surrounds your hse is yours.?? Do we have any recourse at all ??? Thanks..

You will probably get more help if you go back and edit your post. Use complete sentences and punctuation. Ask a clear question...and remember the words are "house" not "hse" and "property" not "propetie":) good luck

No we didn't get a survey done when we bought our house. We were told by our realtor that surveys are not required or performed anymore, since the house was built in 1971. We live in Tennessee, and I can't find any information through the court house or zoning commission or any place else. I have called the realtor who we bought the house from and she said the fence had been up for 21 yrs, and when she rented out the house one of her renters just attached to the fence already in place. The land lord next door said one of his renters actually put the fence up, and the landlord said he was aware the fence that his renter put up was incorrect with regards to the measurement of the property. Our lots are 95 wide and 125 deep the fence his tenant put up makes our property 106 wide. After we bought the property we planted a huge flower bed in the back corner of the yard and planted 2 trees for shade now the renter is saying 10 feet of the property is theirs and they are wanting to take ownership of the trees and flower bed, and the decorations that are placed in the flower bed. My question was can they do that ? Can they yank a fence down that has been in place for 21 yrs ? Do we have any recourse since the realtor we bought the house from led us to believe that our property was the part that was fenced in ?
