landlord/apartment noise problem

los angeles, california - moved into new apartment 3 days ago and the tenet above plays sterio very loud until 4:30 am. it turns out that the landlord has had this problem for 6 months and let us rent it anyhow. the landlord did say that we would be able to bread are lease if it continues. what about the cost of moving, and the wait until we decide the above tenent won't lower the sterio.
